TestNav Privacy Policy
NCS Pearson, Inc. (“Pearson”) respects your right to privacy and has adopted this privacy policy (“Privacy Policy”) to let you know how we collect, use, manage, share, and protect information that we may gather or receive when you use TestNav. This Privacy Policy applies only to the use of TestNav, accessed through the browser or application version, (the “Site”) alone and not in conjunction with any other Pearson products or platforms.
This Privacy Policy applies only to the Site where this notice is posted. Other websites, including other Pearson websites linked through this Site, may have their own privacy policies and practices. Your use of any other website is subject to the privacy policy of that website.
For purposes of this Privacy Policy “Personal Data” is any information that can be used to identify you or that when added with other Personal Data can be linked to you.
By using this Site, you agree to the terms of the Privacy Policy in effect at the time of use. It is your responsibility to read this Privacy Policy and check for updates on a regular basis. By continuing to use our Site, products, or services after such updates have been made, you are agreeing to be bound by any changes to this Privacy Policy. If you do not agree to the terms and conditions of this Privacy Policy, please do not use this Site.
Purpose
Pearson is under contract with certain education agencies (including state education agencies) and educational institutions or organizations (each an “Education Agency” or collectively, “Education Agencies”) to provide assessment delivery services for designated educational assessment programs (“Assessment Programs”). Each Education Agency contracts with Pearson to provide an assessment delivery application associated with their Assessment Program pursuant to agreed upon specifications.
TestNav is a cloud-based application delivering assessments via a web browser on desktop and laptop computers, and a custom application on selected tablets, desktops, and laptops. The core function of TestNav is to deliver tests online to students and collect their responses. Except as noted below, this application is not designed to collect Personal Data from users.
Collection and Use of Information
Secure Assessments. To access a secure assessment, a student inputs the username and password provided by the Education Agency proctor that is unique to that assessment. Passwords are randomly generated; however, the username may be a randomly generated numeric or alphanumeric value, or the applicable Education Agency may choose to utilize student identifiers such as last name and/or student ID as the username. TestNav utilizes this login information to authenticate a student's access to the correct assessment. TestNav collects student assessment responses but is not designed for the collection of Personal Data except as may be described here.
Practice Tests. Access to a practice test, allows, but does not require, a user to insert his or her first and last name. A user may instead decide to insert a pseudonym or leave the default “guest” in the login field blank. The user then selects a specific Assessment Program and identifies the subject and grade for the assessment. Pearson does not retain any of the information the user inserts into the login fields or the user responses.
Help Desk Information. Parents and students should direct all inquiries related to this Site to their school or school district. If Pearson receives an inquiry from an individual regarding this Site, Pearson may collect, use and retain Personal Data included in that inquiry to respond to the individual, to refer the individual and inquiry to the applicable Education Agency, school or school district, perform Site support and issue resolution and maintain business records concerning this Site.
Personal Data from Children
This Site is designed to provide secure online assessments (including practice tests) and supply information to users regarding the assessment. Although this application offers access to assessments to students under the age of thirteen (13), except as outlined here, this Site is intended to supply these assessments without collecting any Personal Data from students, including, but not limited to, those under the age of 13. Pearson will not knowingly collect, maintain, or use any Personal Data supplied by anyone under the age of thirteen (13) through this Site except as provided in this policy and authorized by the Education Agency. Students, especially those under the age of 13, are specifically requested to not provide any Personal Data through this Site.
How Do We Share Personal Data?
Pearson will never sell your Personal Data. Except as specifically stated in this Privacy Policy, it is our policy not to share or disclose Personal Data collected through this Site with third parties other than affiliates of Pearson. We may disclose assessment responses collected in this Site and Personal Data provided to receive support for this Site:
- in response to a subpoena, court order of legal process, to the extent permitted and required by law;
- to maintain security and integrity of this application and our services, to address violations of law, and/or to protect the security of a user or another person;
- in connection with a sale, joint venture, or other transfer of some or all of the assets of Pearson;
- to organizations who are working as contractors, service providers, or agents of Pearson and who are committed or obligated to protect this information in a manner consistent with this Privacy Policy;
- to the Education Agency, or other contractors engaged by the Education Agency, for the Assessment Program for which such information was collected; and
- in order to enforce the Site's Terms of Use and/or any contract between us and such user.
Information Access and Correction
Where Pearson is a service provider and data processor to an Education Agency, your request for access, deletion or correction of your child's education records should be directed to your school. Pearson cannot modify or delete education records or other records collected or processed by, or on behalf of, an Education Agency unless directed to do so by the Education Agency directly.
Data Retention and Destruction
Pearson acts as a data processor for our customers, the Education Agencies, and we process personal information on their behalf and at their direction. Pearson will retain and destroy all data pursuant to the contracts with our customers or other applicable legal requirements.
Disclosure and Transfer of Information
The Site is hosted and operated in the United States and is subject to United States law. We will comply with the privacy and data collection laws of the jurisdiction of the individual from whom the information is collected. Personal Data and information of users located outside of the United States will be transferred to Pearson and our third-party vendors in the United States only to facilitate the purpose for which it was collected. For transfers of personal information from the European Union, the United Kingdom, and Switzerland, we rely on appropriate transfer mechanisms, including but not limited to, Standard Contractual Clauses and performance of contract.
Non-Personally Identifiable Information
We may collect non-personally identifiable information about users whenever they interact with this Site. Such non-personally identifiable information may include the browser name, the type of computer, and technical information about the users' means of connection to our Site, such as the operating system, internet service provider and IP address (a number automatically assigned to the user's computer by their internet service provider). This information is generally collected for system administration purposes, to monitor activity levels, and for security purposes. Pearson does not link IP addresses to Personal Data, except that we reserve the right to link IP addresses and other non-personally identifiable information to protect the integrity of this Site, to monitor compliance with our Terms of Use and for security purposes.
Information Received from Internet Service Providers
This Site receives information that is automatically generated by a user's Internet service provider (ISP). This information may include the IP address (a number automatically assigned to a computer by the ISP when you use the World Wide Web), the associated URLs, domain types, the browser type used to access our site, the pages of our site that the user views during the visit, and the user's website address and email address. Pearson collects this information for system administration purposes, to gather broad demographic information, and to monitor the level of activity on the site. Pearson does not link IP addresses to personally identifiable information.

We use browser cookies and similar technologies (collectively, “Cookies”) to collect and store certain information when you use, access, or interact with our Site(s). We may, for example, collect information about the type of device you use to access the Site(s), the operating system and version, your IP address, your general geographic location as indicated by your IP address, your browser type, the content you view and features you access on the Site(s), whether and how you interact with content available on the Site(s). We reserve the right to update the terms of this Privacy Policy from time to time. Revisions will only be made and apply if consistent with and in accordance with the Assessment Program agreements between Pearson and the applicable Education Agency. Users will be notified of any material changes to this Privacy Policy at login or through a comparable form of notification. We encourage you to visit and review this Privacy Policy periodically to ensure you agree with any changes or updates. We will post our revised privacy notice on our website and update the 'Last Updated' date to reflect the date of the changes.
